The United States Citizenship and Immigration Services (USCIS) has recently announced that they will conduct a second random selection of H-1B cap registrations for the fiscal year (FY) 2024. This comes after an initial random selection was carried out in March 2023, from which only the selected petitioners were eligible to file H-1B cap-subject petitions.
The decision to proceed with a second round of selection comes in response to a determination that additional registrations would be required to meet the numerical allocations for FY 2024. The initial filing period for those with selected registrations in the first round was from April 1, 2023, to June 30, 2023.
USCIS has stated that they will soon begin the process of selecting additional registrations from those that were previously submitted electronically. The process will follow a random selection method similar to the initial round. An announcement will be made upon completion of this second round of selection, and all prospective petitioners with selected registrations will be notified that they are now eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration.
Those who are selected in this upcoming round will find a selection notice updated in their myUSCIS accounts. Both employer’s and attorney’s USCIS account will be notified. The notice will include critical information regarding when and where they can file their H-1B cap-subject petitions.
This announcement indicates a fresh opportunity for those who had submitted their H-1B cap registrations earlier but were not selected in the first round.
