On September 18, 2026, President Trump issued a new Presidential Proclamation extending the $100,000 H-1B payment requirement for another 12 months, through September 21, 2027.
The $100,000 payment requirement was originally imposed in September 2025 and generally applies to certain new H-1B petitions for beneficiaries outside the United States who will need to enter the United States in H-1B status.
The new proclamation does not substantially change the scope of the existing restriction. Instead, it extends the restrictions established by the 2025 proclamation for another year.
As we explained in our September 2025 update on the $100,000 H-1B proclamation, the payment generally does not apply to H-1B extensions, amendments, or changes of status filed for individuals who are maintaining valid status in the United States and remain eligible for the requested in-country benefit. It also does not retroactively apply to H-1B petitions filed before the original September 21, 2025 effective date.
For employers sponsoring workers who are outside the United States, however, the $100,000 payment remains an important consideration when evaluating whether to proceed with a new H-1B petition.
According to the White House, more than 700 H-1B petitions have been accompanied or supplemented by the $100,000 payment since the requirement took effect in September 2025.
The proclamation also continues to permit limited national-interest exceptions where the Department of Homeland Security determines that the employment of particular H-1B workers, workers for a particular company, or workers in a particular industry is in the national interest and does not pose a threat to the security or welfare of the United States.
Unless extended again, the $100,000 H-1B payment requirement will remain in effect through September 21, 2027.
