USCIS Expands Premium Processing to I-140 EB1 (EB1-C) and I-140 EB-2 (NIW)

Update Post, January 12, 2023

Starting January 30, 2023, premium processing will be available to new and pending:

-E13 multinational executive/manager petitions. I-140 (NIW)

-E21 NIW petitions no more phased expansion of premium processing. I-140 (EB-1C)

Update Post, September 16, 2022

USCIS continues to expand premium processing for certain petitioners who have a pending Form I-140, Immigrant Petition for Alien Workers, under the EB-1 and EB-2 classifications.

Beginning September 15, 2022, USCIS will accept Form I-907 requests for:

  • E13 multinational executive and manager petitions received on or before January 1, 2022; and
  • E21 NIW petitions received on or before February 1, 2022.

Note:

  1. USCIS has 45 days to take adjudicative action on cases that request premium processing for these newly included Form I-140 classifications.
  2. USCIS will not accept new (initial) Forms I-140 with a premium processing request at this time.

Update Post, July 15, 2022

USCIS expands premium to pending I-140 under the EB-1 and EB-2 classifications. Just like before, this expansion only applies to those requesting EB-1 immigrant classification as a multinational executive or manager (“EB-1C”) as well as those requesting EB-2 immigrant classification as a member of a profession with advanced degrees or exceptional ability seeking a National Interest Waiver (“EB-2 NIW”).

Starting August 1, 2022, USCIS will accept premium upgrade requests via I-907 for:

  • E13 multinational executive and manager petitions received on or before July 1, 2021; and
  • E21 NIW petitions received on or before Aug. 1, 2021.

Note: As of July 1, 2022, USCIS only accepts the new version of Form I-907 dated 05/31/22.

On May 24, 2022, USCIS announced a phased approach to expanding premium processing to those requesting EB-1 immigrant classification as a multinational executive or manager (“EB-1C”) as well as those requesting EB-2 immigrant classification as a member of a profession with advanced degrees or exceptional ability seeking a National Interest Waiver (“EB-2 NIW”).

The expansion will occur in phases:

  • Beginning June 1, 2022, USCIS will accept premium upgrade requests (I-907) for EB-1C petitions received on or before January 1, 2021.
  • Beginning July 1, 2022, USCIS will accept premium upgrade requests (I-907) for EB-2 NIW petitions received on or before June 1, 2021, and EB-1C petitions received on or before March 1, 2021.

*NOTE* USCIS is NOT accepting any new (initial) Forms I-140 with a premium processing request at this time.
